1. Acceptance

By accessing or using VENTA Hybrid Virtual Drum Machine ("VENTA", the "Service") at ventadrums.com you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

2. Intellectual property

The VENTA name, logo, interface design, source code, sound engine, synthesis algorithms, presets and all related materials are the exclusive property of Tony G and are protected by copyright, trademark and other intellectual-property laws. All rights are reserved. No part of the Service may be copied, reverse-engineered, decompiled, redistributed, resold, sub-licensed or used to train machine-learning models without prior written permission.

3. Licence to use

Subject to these Terms, you are granted a personal, non-exclusive, non-transferable, revocable licence to use the Service for lawful creative purposes, including the creation of original musical works.

4. Your content

Audio you generate, record and export with VENTA belongs to you. You are free to use it in personal, commercial, broadcast or streaming productions, provided you do not claim ownership of the underlying instrument or redistribute VENTA itself. We claim no rights over your recordings.

5. Acceptable use

You agree not to use the Service to (a) infringe any third-party right, (b) attempt to disrupt, overload or compromise the Service, (c) circumvent security or access controls, or (d) use automated means to scrape or mirror the Service.

6. Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or compatible with every browser or device.

7. Limitation of liability

To the maximum extent permitted by law, Tony G and VENTA shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, revenue, profits or recordings, arising out of or related to your use of the Service.

8. Changes to the Service and Terms

We may modify, suspend or discontinue the Service at any time, and may update these Terms. Continued use of the Service after changes constitutes acceptance of the updated Terms.

9. Governing law

These Terms are governed by the laws of the European Union and the jurisdiction of the operator's place of business, without regard to conflict-of-law principles.
